These terms relate to:

Information Security.

The site uses secure server software and hardware in order to protect your information when an order is placed. We adopt a rigid security procedure required under UK Data Protection Legislation (The Data Protection Act 1998) to protect any information we have on yourself from unauthorized access.

Information Required and how we use it.

When an order is placed we require your name, address and Email address, also a valid credit/debit number. We will ask you for your expiry date, security code and a security password if applicable. Without this information your order cannot be processed, nor can a notification confirming your order is issued.
A contact telephone number is required in order that should a problem arise regarding your order, we can contact you immediately. Unless instructed to the contrary we may release this information to our couriers or other agents involved in processing and delivering your order.

Use of Cookies

Our Cookies do not contain any personal information regarding yourself and are used solely to monitor browser and user preference. Your browser software should enable you not to accept cookies should you wish. Without cookies enabled you should still be able to use our site.

You’re Rights.

Should you be concerned for any reason regarding the information we hold under your name, please contact us immediately by Email, telephone or fax and we can review and/or amend your records.
Should we be required to disclose your data by a court order, or in compliance to any legal requirements including exchanging information with companies or organisations for fraud protection or credit risk reduction, we will unless legally restricted, try to contact you in advance.

Intellectual Property.

You understand and agree that all intellectual properties rights, including copyright, trademarks and domain names in all material/content provided in this website or via brochures or promotional literature shall at all time remain sole property of ourselves or our licensors. You are only allowed to use material contained on our site with our express permission or that of our licensors. This site is only available for personal use and any downloading or printing of its contents should be for this purpose only. No commercial use is permitted whatsoever. Linking or framing to the website or any other such operations is strictly forbidden without written permission.

Terms & Conditions

The terms & conditions and the way you use our web site are regulated by English Law and you agree to submit to the non exclusive jurisdiction of the English Court. Your non excludable statutory rights are not affected.
In using our site, any services or products supplied by Kelly’s Soft Furnishings, you will be deemed to have read, understood and agreed to these Terms & Conditions. Should you not agree to any of the Terms & Conditions please contact us directly prior to placing any orders for services or products by Kelly’s Soft Furnishings.

Indemnity & Disclaimer of Warranties.

This site and its contents are produced by Kelly’s Soft Furnishings without any representation, term, condition of warranty of any kind expressed or implied (whether implied by UK law custom or otherwise) with respect to the website & or its contents. Any risks associated with the internet must be accepted by yourself. To the full extent allowed by UK law, we are not liable to you or a third party regarding any loss or damage arising from use of any content on the website or access to the website.
Within these terms and conditions nothing excludes our liability regarding personal injury, death caused by negligence on our behalf.
Our terms and conditions are regulated within the UK under English Law.
Any contract undertaken between a customer and Kelly’s Soft Furnishings for the sale of any of our products or services will only exist once we have accepted the order, processed and despatched the goods which when the buyers credit/debit card will be charged in full including any carriage charge applicable. This does not affect your statutory rights.

You’re Right to Cancel

If you wish to cancel an order (after acceptance by ourselves) for any reason within 7 days of the product been delivered, you must give us written notice (including Email) within that 7 day period. Any cancelled goods within this time frame will be refunded within 30 days. Any cancelled goods must be returned in the conditions set out in (Return Policy) and complete, in perfect condition, not used and in the original packaging.

Transfer.

You cannot transfer your rights and/or delegate your duties under these terms and conditions to any other person/persons.

Return Policy.

Should you not be entirely satisfied with the product you have purchased you must return it within 7 days of receipt. We will be happy to exchange or refund the goods, provided they are returned complete, in perfect condition not used and are in there original undamaged packaging suitable for resale. Kelly’s Soft Furnishings will not accept any costs involved in returning goods purchased unless it is deemed the goods are faulty. If goods are returned and are not deemed faulty P+P of £5.99 will be deducted from your refund.
If you request a curtain alteration NO refunds can be issed on these goods.
Please write or Email us prior to returning goods, stating your order number.

Refund Policy

We reserve the right to refund any orders made on any product on this web site at our discretion.

Consent.

When placing an order on this website you agree to the collection, processing and use of personal information by Kelly’s Soft Furnishings for the purpose of administrating, dealing with your order/account, processing of payment, credit/debit reference check and fraud detection and market research/marketing. Any alterations to our privacy policy will be posted on our site. If you wish to be removed from our database so as not to receive any marketing information please contact us.

The images used on our website are photographed from the products that they represent. However due to lighting affects and individual monitor quality it is not possible to guarantee a true likeness with respect to colour, and we cannot accept responsibility for this.

For our customers convenience we may show links to other sites allowing you to access them for your sole disgression. You understand and agree that we cannot be responsible for the availability of external resources which are not reviewed or endorsed by ourselves. Nor can we accept any responsibility (directly or indirectly) for privacy policies of such websites. Stock.

We do stock a large amount of the goods we advertise on our website however some products we order directly from suppliers when you place an order, which are despatched immediately on arrival at our premises. We endeavour to despatch all orders to our customers within 5-7 working days. If an item is out of stock with ourselves and our suppliers we will update the website as soon as possible and contact any customers awaiting the product with a projected delivery date.
All delivery dates are approximate and may be subject to change. We cannot accept liability for any loss or damage (whether direct or indirect)

Delivery Charges.

Orders in mainland UK over £50.00 are carriage free, all other charges are £5.99, exclusions include. Isle of Man, Isle of White, Northern Ireland and Scottish Highlands delivery rate is £10. Goods Purchased Outside of the UK are not eligable for free delivery. Ireland, France, Germany, Netherlands, Belguim and Luxembourg delivery rate is £21. Spain, Italy, Denmark, Sweden and Finland delivery rate is £28. Austria and Portugal delivery rate is £29. Poland, Czech Republic and Hungary delivery rate is £33. Norway and Switzerland delivery rate is £34. Please contact for carriage charges for countries not listed. The courier we use is Fed-Ex.

Guidelines for Delivery.

Normal delivery is 5-7 working days. (Mon-fri 9.00-5.30)

Curtain Alterations.

Please allow 10 to 24 days for curtain orders with alterations.

Delivery charges may be amended on orders with incorrect shipment/address details.

Please Note.

If our courier is unable to deliver your order due to no one being present at the delivery address stated, a card will be posted indicating a second attempt will be made the following day. (Mon-fri only) If on the second visit no one is present to accept delivery the goods will be returned to the nearest depot where they will be held for 5 working days prior to being returned to ourselves. A new delivery charge will then be raised for any further delivery. Should a change of address occur between order and delivery this charge will also apply.

Should no one be present to accept delivery, delivery charges will not be refundable. Our Courier always requires a signature.

To Return a Product.

Please write or Email stating your intention to return the products and quote your order reference number. For all returns it is your responsibility to arrange and pay for the return of the products to us. We can arrange to collect the products from you however you will be liable for the costs which will be deducted from your refund. When returning goods you are strongly advised to obtain proof of delivery, as lost or damaged goods cannot be held responsible to us in transit.

Kelly’s Soft Furnishings try to provide the very best service, whether you are totally satisfied with your purchase or you wish to return it or exchange it.

Should you not be happy with your goods from Kelly’s Soft Furnishings, please return them within 7 days of receipt. Email/write to us with your intentions and quote your reference number.

All returned goods must be in perfect condition and in their original packaging. Once received we will be happy to exchange or refund the product to your satisfaction.

You are recommended to get p.o.d. (proof of delivery) as any goods lost or damaged will not be the responsibility of Kelly’s Soft Furnishings.

We will only accept responsibility for carriage charges, if in the opinion of Kelly’s Soft Furnishings the returned goods are faulty. Maximum refund for carriage costs are £6.99

If you choose to exchange a product there may be a price differential. Should your alternative choice be more expensive an additional payment will required. Should your alternative choice be cheaper a refund will be raised. All exchanges will incur a further carriage charge payable by yourself.

Payment Method

You can pay by cheque, however goods will not be released until the cheque has cleared in our account. All cheques must be made payable to Kelly’s Soft furnishings with your order reference and full address on the back of the cheque.

Card Payments.

Online payments can be made with Visa, MasterCard, Delta and Switch. All payments are in £'s (pounds sterling)

On-line Payment Security.

We do not store any Credit/Debit cards details on our server and use WorldPay as a Payment Solutions Provider.
Security is probably one of the most significant concerns for both the shopper and the retailer during an online transaction. In reality, an online transaction is probably more secure than a card transaction in a shop or conducted over the telephone or by fax, as the information transmitted online is strongly encrypted using complicated logarithm combinations.

The WorldPay payment system uses a combination of both established and innovative techniques to ensure the security and integrity of all sensitive data. Furthermore, our public web servers are certified by Thawte, a public Certificate Authority, ensuring that both the shopper and retailer can have confidence that nobody can impersonate WorldPay to obtain confidential information.

Transaction Encryption
The transfer of the purchase details from the retailers site to Worldpay are encapsulated using our own encrypted and digitally-signed protocol. This uses a combination of standard methods such as PGP, RSA and MD5 to ensure that the information passed is secure and tamper-proof via SSL.

Security for the Shopper
Any communication between the shopper and WorldPay is also encrypted to the maximum strength supported by the shopper's browser using 128 Bit SSL. Shoppers are also protected from fraudulent use of their card in a "card not present" environment, by their card issuers. The card issuers provide the right for shopper to dispute a transaction if the goods/services did not arrive or if the card was used fraudulently.

Data Storage
Data storage on WorldPay systems, and the communication between WorldPay and the worldwide banking networks, is regularly audited by the banking authorities to ensure a secure transaction environment. We also ensure that we stay up-to-date with the latest versions of any third-party code we use, and continually review our own proprietary code.
